What is the American Indian exemption?

You may be able to subtract all or part of your income if all of the following are true:

  • You are an enrolled member of a federally recognized American Indian tribe and
  • Your income was from sources within federally recognized Indian country in Oregon, and
  • You lived in federally recognized Indian country in Oregon when the income was earned.
You must download the Exempt Income Schedule for Enrolled Members of a Federally Recognized American Indian Tribe  and attach the completed form to your return.

After you have completed the form, enter your total exempt American Indian income on this screen to have this income subtracted from your Oregon taxable income.

By subtracting exempt American Indian income, you will need to mail your Oregon tax return with your completed Exempt Income Schedule for Enrolled Members of a Federally Recognized American Indian Tribe. Further on we'll walk you through how to mail your return.
