OFFICIAL RULES FOR THE FREETAXUSA $25,000 GIVEAWAY

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. An individual participating in any aspect of this Giveaway is sometimes referred to in these Official Rules as an “entrant.” BY PARTICIPATING IN ANY ASPECT OF THIS GIVEAWAY, EACH ENTRANT AGREES TO ABIDE BY THESE RULES. FAILURE TO ABIDE BY THESE OFFICIAL RULES WILL VOID AN ENTRANT’S ENTRY IN THE GIVEAWAY.

PRIVACY:

  • Information submitted by entrants as part of this Giveaway WILL NOT BE ADDED TO ANY PROMOTIONAL LIST and will only be used to contact the participant in the event they win the prize. Information will be treated in accordance with Sponsor’s Privacy Policy, which is available at https://www.FreeTaxUSA.com/privacy.
  • Due to tax privacy regulations, the number of qualified entries cannot be disclosed to the participant.

ENTRY PERIOD:

  • The FreeTaxUSA $25,000 Giveaway (the “Giveaway”) begins on October 27, 2025 at 12:00:00 a.m. Eastern Time (“ET”) and ends on October 26, 2026 at 11:59:59 p.m. ET (the “Entry Period”). Sponsor’s designated computer is the official time clock for this Giveaway.

HOW IT WORKS:

  • Link Generation: After successfully filing taxes, or creating an account, through FreeTaxUSA.com, participants will be issued a unique sharing link. The link is designed for participants to invite others to file their taxes using FreeTaxUSA.com and can be shared via text messages, social media, email, or other methods.

DEFINITIONS:

  • Qualifying Filed Tax Return: Any self-prepared tax return, on a TaxHawk, Inc. service, that is e-filed and accepted by the IRS or designated to be mailed to the IRS during the entry period above.

ENTRY METHODS:

  • Method 1:
    • Referral Entries: For each individual referred by the participant's unique link who then has a qualifying filed tax return (as defined above) on a TaxHawk, Inc. service during the specified period, the participant will receive one (1) entry for each qualifying referral with a maximum of ten (10) referral entries. AS THE PARTICIPANT, YOU MUST INFORM YOUR REFERRALS THAT YOU WILL RECEIVE AN ENTRY IF THEY SUCCESSFULLY FILE THEIR TAXES USING A TAXHAWK, INC. SERVICE AND YOU, AS THE PARTICIPANT, AGREE TO DO SO. You agree that failure to inform your referral that you may receive a reward if they make a qualifying filed tax return is a violation and may result in your immediate termination from the Giveaway.
  • Method 2 – Entering By Mail, without signing into or creating an account on FreeTaxUSA.com:
    • Alternatively, you may enter by sending your name, email, phone number, and physical mailing address, and the words “FreeTaxUSA Giveaway” on a 3”x5” piece of paper, place it in a #10 business-size envelope, and mail to: TaxHawk, Inc. Attn: “FreeTaxUSA Giveaway”, PO Box 51048, Provo, UT 84605-1048. Mail-in entries, including the outer envelope, must be handwritten. All information provided must be valid. Entries submitted by mail must have adequate postage, be postmarked during the Entry Period, have a valid return address (which includes first and last name), and be received by Sponsor no later than 7 days after the end of the Entry Period. Each qualifying mail-in envelope, meeting the guidelines outlined above, will receive ten (10) entries. Limit 10 entries per individual and qualifying envelope.
  • Maximum Entries Per Participant:
    • There is a cap of ten (10) entries that any single participant may accumulate over the course of the giveaway date range through the aforementioned methods.

ELIGIBILITY REQUIREMENTS:

  • The Giveaway is open to legal residents of the 50 United States and the District of Columbia, but excluding New York, Puerto Rico, Rhode Island, and Florida, who are at least 18 years of age or older and of the age of majority in their jurisdiction of residence as of the date of entry submission. Employees, contractors, directors and officers of Sponsor, its subsidiary and affiliated entities, advertising, and fulfillment agencies involved in the administration, development, fulfillment, and execution of this Giveaway (collectively, “Giveaway Parties”), and the immediate family members and/or those living in the same household of any such persons or entities are not eligible. For these Official Rules, “immediate family” means mother, father, siblings, children, wards, grandparents, grandchildren, and any “step” relationships of the foregoing, domestic partners and spouses, including common law spouses, regardless of where they reside. The Giveaway is subject to all applicable federal, state, provincial, and local laws. Void where prohibited or where restricted by law in a manner inconsistent with these Official Rules.

AN ENTRANT’S ENTRY INTO THIS GIVEAWAY IS A REPRESENTATION THAT THE ENTRANT HAS COMPLIED WITH THESE OFFICIAL RULES.

RANDOM DRAWING TO DETERMINE WINNER:

  • Entries will be entered into a random drawing to be conducted on or about . Subject to verification and compliance with the Official Rules, one (1) entrant will be selected to receive the prize (such prize is defined below).

NOTIFICATION OF SELECTED ENTRANT; DESIGNATION OF WINNER:

  • The Prize winner will be confirmed following selection by a random drawing on or about the date specified for the drawing in these Official Rules and subject to compliance with the Official Rules. Sponsor will attempt to notify the entrant who has been selected in the drawing at the phone number or email address in their account or provided in the entry (at Sponsor’s election). To be confirmed a winner, the selected entrant will be required to sign and return to Sponsor within seven (7) days of notification attempt, an Affidavit of Eligibility, Liability, and Publicity Release (where permitted by law) (the “Affidavit”) or the applicable prize will be forfeited, and an alternate winner may be determined. Following timely receipt of the Affidavit and confirmation by Sponsor of compliance with the Official Rules, a selected entrant will be confirmed a winner and will receive the Prize. Except where prohibited by law, the Prize winner further grants to Sponsor the right to use such winner’s name, photograph, voice, likeness, and city of residence for purposes of advertising or promoting and publicizing the efforts and activities of Sponsor and the Giveaway without further consideration and to release such individual’s name to persons requesting the name of the winner of the Giveaway and to post the name of the Winner on Sponsor’s websites and social media accounts.

PRIZE:

  • The following Prize will be awarded to the one entrant who is determined by Sponsor to be the Prize Winner: Twenty Five Thousand Dollars ($25,000). Odds of winning depend on the total number of entries received. All federal, state, and local taxes and any expenses, costs, duties, or fees associated with the acceptance and/or use of any prize are the sole responsibility of the prize winner. As a condition to receiving the Prize, the selected entrant must provide their valid Social Security number or tax payer identification number and accurately complete and provide to Sponsor IRS Form W-9 that will be provided to the selected entrant. Sponsor and the Giveaway Parties assume no responsibility or liability for damages, losses, or injury resulting from acceptance or use of prize or participation in the Giveaway. Sponsor reserves the right to request from any entrant additional documentation it reasonably believes is necessary to validate any Entry or to award any prize. The Sponsor retains the authority to audit entries for authenticity and compliance with these rules. Entries deemed to have been obtained through fraudulent means or in violation of these rules may be disqualified at the sole discretion of the Sponsor. The total number of prizes to be awarded in the Giveaway is one (1).

GENERAL CONDITIONS:

  • By participating in the Giveaway, entrants agree to these Official Rules and the decisions of Sponsor with respect to the Giveaway and the awarding of any prize, which shall be final and binding in all respects. Sponsor and its agents are not responsible for late, lost, illegible, or postage-due communications, technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications, or by any of the equipment or programming associated with or utilized in this Giveaway, or by any human error which may occur in the processing of the entries in this Giveaway, or for any liability for damage to any computer system or device resulting from participation in, or accessing or downloading information in connection with this Giveaway. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Giveaway is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Giveaway process, then Sponsor reserves the right at its sole discretion to cancel or modify the Giveaway. If a court of competent jurisdiction deems any provision of these Official Rules invalid or unenforceable, such provisions shall be enforced to the maximum extent permitted and the remaining provisions of the Official Rules shall remain in full force and effect.

MARKETING AND PUBLICITY RELEASE:

  • By participating in the Giveaway, which represents good and valuable consideration exchanged, you grant TaxHawk, Inc. and its affiliates, successors, licensees, and assigns a worldwide, royalty-free, non-exclusive license to use your name, likeness, image, voice, statements, and biographical information (“Identity”) in any media now known or later developed for advertising, marketing, and promotional purposes, in perpetuity, except if prohibited by law then the maximum period permitted by applicable law, without further approval or compensation.
  • You acknowledge that TaxHawk, Inc. owns all rights in any materials created in connection with the Giveaway (“Materials”) and may edit, modify, and use them at its discretion and without your prior approval. To the extent you contribute to the Materials, all results and proceeds are “work made for hire”; if not, you assign all rights, including copyrights, to TaxHawk, Inc. and waive any moral rights (droits moraux). You agree to execute documents as needed to confirm ownership and appoint TaxHawk, Inc. as attorney-in-fact to do so if you are unable or unwilling.
  • You release and waive all claims against TaxHawk, Inc. and its affiliates arising from use of the Materials or your Identity, including claims for copyright infringement, defamation, privacy, or publicity, to the fullest extent permitted by law.

LIMITATIONS OF LIABILITY AND RELEASE:

  • BY PARTICIPATING IN ANY ASPECT OF THE GIVEAWAY, YOU AGREE TO THE FULL EXTENT PERMITTED BY LAW TO RELEASE AND HOLD HARMLESS SPONSOR, THE GIVEAWAY PARTIES, AND THEIR RESPECTIVE PARENT, SUBSIDIARIES, AFFILIATED ENTITIES, AGENTS, ADVERTISING AND GIVEAWAY AGENCIES, AND ALL OF THEIR RESPECTIVE SHAREHOLDERS, OFFICERS, DIRECTORS, EMPLOYEES AND ASSIGNS, MEMBERS, REPRESENTATIVES, AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”), FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN ANY PART OF THE GIVEAWAY (INCLUDING, WITHOUT LIMITATION, PREPARING FOR OR PARTICIPATING IN OR SUBMITTING ANY ENTRY AND/OR FROM ANY GIVEAWAY RELATED ACTIVITY) OR RECEIPT OR USE OF ANY PRIZE, INCLUDING PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH. EACH ENTRANT FURTHER AGREES THAT IN ANY CAUSE OF ACTION, THE RELEASED PARTIES’ LIABILITY WILL BE LIMITED TO THE OUT OF POCKET COST OF PARTICIPATING IN THE GIVEAWAY, AND IN NO EVENT SHALL THE GIVEAWAY PARTIES BE LIABLE FOR ATTORNEYS’ FEES, PUNITIVE, CONSEQUENTIAL, DIRECT, OR INDIRECT DAMAGES, AND EACH ENTRANT WAIVES THE RIGHT TO CLAIM ANY DAMAGES WHATSOEVER. YOU HEREBY WAIVE ALL RIGHTS AND RELEASE EACH OF THE RELEASED PARTIES FROM ANY CLAIM OR CAUSE OF ACTION, WHETHER NOW KNOWN OR UNKNOWN, OF ANY KIND, INCLUDING BUT NOT LIMITED TO DEFAMATION, INVASION OF RIGHT TO PRIVACY, PUBLICITY OR PERSONALITY, OR ANY SIMILAR MATTER, RELATING TO THE GIVEAWAY, THE OPERATION THEREOF, EITHER INTENTIONALLY OR OTHERWISE. YOU HEREBY REPRESENT AND WARRANT THAT YOU HAVE READ THESE OFFICIAL RULES AND ARE FULLY FAMILIAR WITH THEM.

APPLICABLE LAWS AND JURISDICTION:

  • Issues concerning the construction, validity, interpretation, and enforceability of these Official Rules shall be governed by the laws of the State of Utah. All disputes arising out of or connected with this Giveaway will be resolved individually, and without resort to class action, exclusively by the exclusive personal jurisdiction and venue of the state or federal courts encompassing Provo, Utah. Should there be a conflict between the laws of the State of Utah and any other laws, the conflict will be resolved in favor of the laws of the State of Utah. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Giveaway and shall not include any indirect, punitive, incidental, and/or consequential damages.

WINNERS LIST:

  • To receive a copy of the Winner’s List by mail, send a self-addressed stamped envelope (except where not required by applicable law) to Sponsor at the Giveaway Address. Limit one request per outer mailer which should be marked “The FreeTaxUSA $25,000 Giveaway Winners List Request.” Requests must be received within six months of the end of the Entry Period. Limit one request per outer mailer. The name of the Prize winner may be posted on social media websites or posted on any TaxHawk property.
