What if I'm a widowed taxpayer and I'm selling my home?

You may be able to include any time when your late spouse owned and lived in the house for the ownership and residence requirements, even if it was without you.

To include the time your spouse owned and lived in the house, the following must be true:
  1. You sold your home within 2 years of your spouse's death.
  2. You haven't remarried at the time of the sale.

For example, if you only lived in the home for 18 months in the last five years but your spouse lived in the home for four of the last five years, answer Yes to the question that asks if you lived in your home for at least two out of the five years before it was sold.
