My child's other parent claims my child as a dependent, but my child lives with me. Can I still claim the Earned Income Credit and Child and Dependent Care Credit?

Yes, if your child lives with you for more than half of the year you are the custodial parent. As the custodial parent, you can claim the Earned Income Credit, Child Care Credit, and you may be able to file with the Head of Household filing status.

Enter the information for your child and we'll walk you through all the questions needed to make sure you claim your child correctly.

Your child's other parent will enter the dependent on their return as well, but they'll need to indicate the child doesn't live with them and that they're claiming the child under a custody agreement. That way the IRS knows that the child is being reported on two returns. If your child's other parent doesn't correctly indicate that they don't live with the child, the IRS may reject your tax return and tell you the child has already been claimed on another tax return.
