If you are a nonresident spouse of an active-duty military servicemember stationed in Montana, your wages are not taxable in Montana if you are in Montana solely due to your spouse's military orders. If your only Montana income and tax withholdings are from wages, you aren't required to file a Montana tax return and can file as a nonresident military spouse to claim a refund of any Montana taxes withheld from your wages.

Yes to this question if you are filing ONLY to claim a refund of your wage withholdings. If you or your spouse have other income that is taxable to Montana, you do NOT qualify to file as a nonresident military spouse and you'll need to file a normal Montana nonresident tax return. You'll still be able to deduct your wages from Montana taxable income and will only be taxed on other Montana income.
If you don't want your employer to withhold Montana income tax from your wages, you must claim the military spouse exemption on Montana
Form MW-4 and give that form to your employer.
