Can I file a joint Kansas return if my spouse and I have different residency statuses?

Our software currently does not support filing a joint Kansas return when spouses have different residency statuses (for example, one spouse is a resident and the other is a part-year or nonresident).

To file using our software, both spouses MUST use the same filing status on their federal and Kansas returns. The way to do this depends on the spouse's residency status:
  • If one spouse is a nonresident and you file jointly on the federal return, you MUST file a joint Kansas return treating both spouses as nonresidents, or
  • If one spouse is a part-year resident, both spouses MUST file as Married Filing Separately on both the federal and Kansas returns and use their own residency statuses on the Kansas returns.

If you and your spouse choose to file as Married Filing Separately due to different residency statuses, you will need to set up two separate FreeTaxUSA accounts and file your state returns separately.
