Can I file a joint Rhode Island return if my spouse and I have different residency statuses?

You and your spouse must use the same filing status as your federal return for your Rhode Island return. If you are a resident and your spouse is either a non-resident or a part-year resident, you have two options for how to file:

  1. If filing jointly on your federal return, you must file your Rhode Island return as if you were both Rhode Island residents.
  2. If filing separately for your federal return, you must both have an account with FreeTaxUSA and individually file state and federal returns.
In most cases, we recommend you choose to file separately to minimize your state taxes owed.
