To be considered a business you need to do all of the following:
- Own the property primarily to earn a profit
- Rent it out
- Work at it regularly and continuously
If you provide substantial services that are primarily for your tenant's convenience, this would be considered a business.
Example 1: You own a vacation home that you use part of the year, but rent out occasionally. This is not a business as your primary purpose is not to earn a profit.
Example 2: You own a property with the primary purpose of renting it out to earn a profit from your tenants. You can consider it a business if you or an agent continue to regularly do work related to renting out the property such as repairs, upkeep, advertising, etc.
