When is a care provider a household employee?

If you pay someone to come to your home and care for your dependent or spouse and you can control not only what work is done, but how it's done, you may be a household employer. For example, this generally includes nannies but not daycare centers.

If you're a household employer, you may need to file Schedule H with your tax return and pay household employment taxes.
